<p class="texto">Escolhido inicialmente para relatar o PL que prevê a taxação dos investimentos feitos no exterior — os fundos <em>offshore</em> —, o parlamentar informou que vai incorporar o texto da medida provisória (MP) que trata da tributação dos fundos exclusivos, também chamados de <em>onshore</em> ou fundos dos super ricos. Entrarão no mesmo parecer as alterações nas regras dos Juros sobre Capital Próprio (J), encaminhada pelo governo na Medida Provisória 1.185/23.</p>
<p class="texto">O J foi um mecanismo criado na década de 1990, para permitir que as empresas pudessem distribuir os lucros entre seus acionistas sem a incidência do Imposto de Renda (IR) e da Contribuição Social sobre o Lucro Líquido (CSLL) sobre o valor rateado. Na MP encaminhada em agosto, o governo propôs o fim desse regime. Mas o <a href="/brasil/2023/10/5130427-setores-conservadores-do-congresso-aceleram-acoes-contra-aborto.html">Congresso</a> não recebeu bem a proposta, o que forçou a nova negociação.</p>
<p class="texto">"Estamos discutindo a possibilidade de que o J cumpra suas funções e se alinhe às práticas internacionais e à efetiva capitalização a partir dos sócios", disse. A ideia é que os empresários que utilizam o J tenham o benefício, mas que isso não funcione para evasão fiscal.<div class="read-more">

O J foi um mecanismo criado na década de 1990, para permitir que as empresas pudessem distribuir os lucros entre seus acionistas sem a incidência do Imposto de Renda (IR) e da Contribuição Social sobre o Lucro Líquido (CSLL) sobre o valor rateado. Na MP encaminhada em agosto, o governo propôs o fim desse regime. Mas o Congresso não recebeu bem a proposta, o que forçou a nova negociação.
"Estamos discutindo a possibilidade de que o J cumpra suas funções e se alinhe às práticas internacionais e à efetiva capitalização a partir dos sócios", disse. A ideia é que os empresários que utilizam o J tenham o benefício, mas que isso não funcione para evasão fiscal.
